Terms of Service

1. Acceptance of Terms

By accessing or using NudeLockr ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Service Description

NudeLockr provides forensic content protection tools for adult content creators, including:

• Invisible forensic watermarking via enterprise-grade third-party APIs
• Perceptual hash fingerprinting for content identification
• Certificate of Authenticity generation with cryptographic proof of ownership
• Trace Checker for verifying ownership of suspected leaked content
• DMCA takedown notice generation tools

Important: NudeLockr does NOT store your original full-resolution files. We only retain low-resolution thumbnails (300x300px) and cryptographic fingerprints for identification purposes.

3. Eligibility

You must be at least 18 years old to use this Service. By using NudeLockr, you represent and warrant that:

• You are 18 years of age or older
• You own or have legal rights to all content you upload
• Your use complies with all applicable local, state, and federal laws

4. Acceptable Use

You agree NOT to use NudeLockr to:

• Upload content depicting minors or non-consensual acts
• Upload content you do not own or have rights to protect
• File false DMCA takedown notices (doing so may result in legal liability)
• Reverse engineer, decompile, or abuse the watermarking system
• Harass, threaten, or harm others
• Violate any applicable laws or regulations

Violation of these terms may result in immediate account termination without refund.

5. Content Ownership and Privacy

You retain all ownership rights to your content. By using NudeLockr, you grant us a limited license to:

• Process your uploaded files to generate watermarks and fingerprints
• Store low-resolution thumbnails (300x300px) for dashboard display
• Generate Certificates of Authenticity linked to your account
• Extract watermarks from files you submit via the Trace Checker

We delete your original full-resolution files immediately after processing. Thumbnails and fingerprints are encrypted and stored securely.

6. Subscriptions and Payment

• Free Plan: 5 NLr-Credits/month for 3 months, Certificates of Authenticity, basic DMCA templates
• Starter Plan ($29/month): 170 NLr-Credits/month, Trace Checker access, 15% bundle discount
• Creator Plan ($59/month): 400 NLr-Credits/month, Chrome extension, 20% bundle discount
• Pro Plan ($149/month): 1100 NLr-Credits/month, priority support, 25% bundle discount

Subscriptions are billed monthly via Stripe. You may cancel at any time. See our Refund Policy for cancellation terms. Credit usage: 1 credit per image protected, 1 credit per second of video protected, 1 credit per Trace lookup.

7. Service Credits

7.1 What Credits Are

NudeLockr uses a credit system ("NLr-Credits" or "Credits") to meter access to certain features such as watermarking, tracing, and other protected services. Credits are a unit of service, not a form of currency. Credits are only redeemable inside NudeLockr for eligible features and have no cash or stored-value equivalent.

7.2 Accrual and Rollover

Depending on your subscription tier, a set number of Credits are added to your account each billing cycle. Unused Credits automatically roll over to the next billing period and may be used as long as your account remains active and in good standing. Free tier users receive 5 Credits/month for their first 3 months and may purchase additional Credits at standard pricing.

7.3 No Cash Value; Non-Refundable

Credits are personal to your account and may not be sold, assigned, transferred, or shared with other users or accounts without our prior written consent.

7.5 Expiration and Changes

Credits do not expire while your subscription remains active and your account is in good standing. If your account is terminated, suspended, or inactive for a prolonged period (90+ days), any remaining Credits may be forfeited at our discretion. We may, from time to time, introduce an expiration period for Credits or modify existing policies. If we implement or materially change an expiration policy, we will provide reasonable advance notice (for example, by email or in-app notification).

7.6 Refunds, Chargebacks, and Credit Value

In the event of a refund or chargeback, Credits associated with that transaction will be deducted from your account. If your Credit balance is insufficient, your account may be suspended until the balance is resolved. Refunds and chargebacks do not create cash value for any Credits already consumed or remaining in your account.

8. Service Limitations and Disclaimers

NudeLockr provides forensic tools to help protect your content, but we cannot guarantee:

• Prevention of all unauthorized distribution of your content
• Successful removal of infringing content (platforms make final decisions)
• Watermark extraction from heavily modified or destroyed copies

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE ARE NOT LIABLE FOR ANY DAMAGES ARISING FROM USE OF THE SERVICE.

9. No Legal Advice

9.1 No Attorney–Client Relationship

NudeLockr, its owners, employees, contractors, and affiliates are not a law firm and do not provide legal services. Your use of the NudeLockr platform does not create an attorney–client relationship with NudeLockr or any of its personnel.

9.2 Informational and Operational Use Only

All content, tools, dashboards, alerts, reports, recommendations, and other features provided by NudeLockr (collectively, the "Services") are offered for general informational and operational purposes only. They are intended to help you manage and monitor your own content, but they are not a substitute for professional legal advice, analysis, or judgment.

9.3 No Legal Opinions or Guarantees

NudeLockr does not provide legal opinions, does not determine whether any particular content is lawful or unlawful, and does not guarantee that any suggested actions (including takedown notices, DMCA-related workflows, or other communications) are legally sufficient, effective, or appropriate in any specific jurisdiction.

9.4 You Are Responsible for Your Legal Decisions

9.5 Jurisdictional Differences

Laws and regulations relating to copyright, DMCA, privacy, adult content, and content moderation vary by country, state, and platform. NudeLockr does not warrant that its tools or workflows comply with the laws of any particular jurisdiction. It is your responsibility to ensure your use of the Services complies with all applicable laws, rules, and platform policies.

10. Identity Verification (Optional)

10.1 Availability

Identity Verification is an optional feature available exclusively to paid subscribers (Starter, Creator, and Pro tiers). Free tier users do not have access to this feature. Identity verification is not required to use any core NudeLockr features.

10.2 Purpose

Verified users receive a "VERIFIED" badge displayed on their Certificates of Authenticity and DMCA takedown notices. This badge indicates that the user has successfully verified their real-world identity through our third-party verification provider, adding additional credibility to ownership claims and takedown requests.

10.3 Verification Process

Identity verification is performed by Stripe Identity, a third-party identity verification service. NudeLockr does not directly collect, view, or store your government-issued ID documents, ID numbers, or biometric data. Stripe Identity processes your verification independently and only communicates the verification result (verified/not verified) and timestamp to NudeLockr.

10.5 No Guarantee of Outcomes

While identity verification may strengthen your DMCA claims and add credibility, NudeLockr makes no guarantee that verification will result in faster takedowns, successful legal outcomes, or any specific treatment by third-party platforms. The verified badge is informational only and does not constitute legal certification or endorsement.

11. Third-Party Services

NudeLockr uses third-party services for forensic watermarking, storage, authentication, identity verification, and payments. We are not responsible for their availability, accuracy, or data handling practices.

12. DMCA Safe Harbor

NudeLockr is a platform provider and does not pre-screen user content. If you believe content on our platform infringes your copyright, contact us at hello@nudelockr.com with a valid DMCA notice.

13. Indemnification

You agree to indemnify and hold NudeLockr harmless from any claims, damages, or expenses arising from:

• Your use of the Service
• Your uploaded content
• Your violation of these Terms
• False DMCA notices you submit

14. Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms, illegal activity, or abuse of the Service. Upon termination:

• Your access to protected files and certificates will be revoked
• Stored thumbnails and fingerprints may be deleted after 30 days
• No refunds will be issued for violations

15. Changes to Terms

We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance. Material changes will be communicated via email.

16. Governing Law

These Terms are governed by the laws of the State of Florida, USA. Any disputes shall be resolved in Florida courts.
